13 Amending a U.S. Return (Form 1040-X) and the Time Limits

Question for this chapter. If you think you overpaid U.S. tax on a return you already filed, how long do you have to claim it back, and does the clock start at filing or at payment?

Answer. You correct a filed return with the amended return form, Form 1040-X, which works the same way whether you owe more or are asking for money back. For most corrections the claim window is counted from the filing date or the payment date, and the later of the two applies. Some items, such as foreign tax, bad debts, loss carrybacks and disaster losses, follow their own separate time limits.

What to check

What to confirm. Confirm which kind of correction you are making, then match it to the correct starting date and time limit in the current IRS instructions for Form 1040-X.

One-line summary. Amending a U.S. return starts with identifying what you are correcting, because the deadline depends on the item and on which date it is counted from.
